Terms of Service

1. Who may use StalkAI

You must be at least 16 years old to use the Services. By using them you confirm that you meet this requirement and that you are allowed to enter into these Terms. You may have one personal account; accounts may not be sold, transferred or shared.

2. Your account and sign-in

• You sign in with a verified email address, mobile phone number, Apple, Google or a passkey. Keep your sign-in methods secure and up to date; they are also how you recover your account on a new device.
• You are responsible for all activity under your account. If you notice a sign-in you do not recognise, sign the device out in the App and contact us.
• Information you provide must be accurate. Do not create accounts in someone else's name or with automated means.

3. Your content

You keep all rights to the content you create in StalkAI — profiles, photos, texts, messages and chats ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to store, process, display and transmit Your Content only to the extent necessary to provide the Services to you and to the people you share it with. This licence ends when you delete the content or your account, except for copies we must keep by law.

You confirm that you have the necessary rights to Your Content, including the consent of any person shown in photos you upload or whose profile you create.

4. Profiles of other people

StalkAI lets you create profiles of people you know, for example to compare personalities. Only use information you are entitled to use, treat it with respect, and do not publish profiles of other people without their consent.

5. Acceptable use

You must not:

• harass, threaten, stalk, defame or discriminate against anyone;
• share illegal, sexually explicit, violent or hateful content, or content involving minors in any harmful way;
• impersonate others or create fake or misleading profiles;
• send spam, advertising or chain messages;
• access the Services by automated means, scrape data, circumvent security or rate limits, or interfere with their operation;
• reverse-engineer the App, except where the law expressly allows it.

6. AI features

Astrological, numerological and personality data as well as answers of the AI assistant are generated automatically. They are meant for self-reflection and entertainment and are not professional advice (medical, psychological, legal, financial or otherwise). They can be inaccurate or incomplete. Do not base important decisions on them alone, and do not use the AI assistant to create content that violates Section 5.

7. Subscriptions and stars

StalkAI can be used free of charge with limits. With a paid subscription (Premium or Premium Plus) you get higher limits and additional features. What each plan includes, and its price, is shown in the App before you buy.

• Purchase and payment: subscriptions and stars are bought exclusively through Apple's App Store or Google Play and charged to your store account. The store's terms of purchase apply in addition to these Terms. Prices include the VAT collected by the store.
• Renewal and cancellation: subscriptions renew automatically for the same period (one month or one year) unless you cancel at least 24 hours before the end of the current period in your App Store or Google Play account settings. Deleting the App or your account does not cancel a subscription.
• Free trial: if a free trial is offered, the subscription starts automatically at the end of the trial unless you cancel at least 24 hours before it ends.
• Refunds: refunds are handled by Apple or Google under their policies; we cannot issue refunds for store purchases ourselves. Statutory rights remain unaffected.
• Stars: stars are a prepaid allowance for AI messages, used only once the allowance of your plan is exhausted (1 star per message, larger analyses cost more as shown in the App). Stars do not expire, cannot be transferred or exchanged for money, and are tied to your account. If a purchase is refunded, the corresponding stars are removed.
• Fair use: limits described as "unlimited" are subject to fair use to protect the Services from abuse; normal personal use is never affected.
• Changes to plans and prices: we may change plans, limits and prices for the future. Price increases for existing subscriptions take effect only with the notice and, where required, the consent provided for by the store.

8. Moderation, restrictions and appeals

We may review reported content and remove content that violates these Terms or the law. If you violate these Terms, we may warn you, temporarily suspend or permanently ban your account, and prevent you from creating a new one. Where possible, the App tells you the reason. You can appeal a restriction directly in the App; we review every appeal and inform you of our decision.

9. Ending your use

You can delete your account at any time in the App or in the browser. Deletion is permanent; see Account deletion for what is removed. We may end these Terms and close accounts in the case of serious or repeated violations, or if we discontinue the Services, in which case we will inform you in advance where reasonably possible.

10. Availability and changes

We continuously develop StalkAI and may add, change or remove features. We aim for high availability but cannot guarantee that the Services are always available or free of errors. Some features may require the latest version of the App.

11. Liability

To the extent permitted by law, we are liable only for damage caused intentionally or through gross negligence. Liability for slight negligence, indirect or consequential damage and lost profits is excluded. Mandatory statutory liability, in particular for personal injury, remains unaffected. We are not responsible for content that other users create or share.

12. Changes to these Terms

We may update these Terms, for example when we change features or when the law changes. We will inform you of material changes in the App or by email in good time. If you continue to use the Services after the changes take effect, the new Terms apply; if you do not agree, you can delete your account.

13. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the seat of Stalk GmbH. If you use the Services as a consumer, mandatory consumer-protection provisions and places of jurisdiction of your country of residence remain unaffected.
